TRANSFERS OF YOUR PERSONAL DATA

Your personal information may be transferred to, and stored at a destination outside of the European Economic Area, including the US or the UAE.

Please note that the European Commission (EC) has the power to determine, on the basis of the GDPR, whether a country outside the EU offers an adequate level of data protection. As at the date of this Update: the EC has recognised the US (limted to the Privacy Shield Framework) as providing adequate protection. (The Privacy Shield Framework, which became operational on 1 August 2016, protects the fundamental rights of anyone in the EU whose personal data is transferred to the US for commercial purposes.); has not recognised the UAE as providing adequate protection although the UAE has indicated it aims to 'reconcile its operational procedures with the European authorities, in adherence with the framework of the GDPR.'

The GDPR provides those who have provided data with a right to lodge a complaint with a supervisory authority. However, as at the date of this Update, the British Virgin Islands (where we are incorporated) has not designated a data supervisory authority within the meaning of the GDPR, although we believe the BVI Government has pledged to pass suitable data protection legislation, based on internationally recognised standards, in the near future. The supervisory authority in the UAE (where our website is administered) is the Telecommuications Regulatory Authority (TRA).
